“Rent may be adjusted at Landlord's sole discretion … binding upon Tenant for the remainder of the Term.”

Section 3.2

Even though this is a 12-month lease, the landlord reserves the right to increase your rent during the term with only 15 days' notice. A fixed-term lease is supposed to fix the rent for the term; this clause makes that promise meaningless.

Recommendation — Negotiate to lock rent for the full lease term, or at minimum cap any increase to a single CPI-indexed adjustment with 60+ days' notice. If they refuse, walk away — this clause makes your housing budget unpredictable.

“10% of the monthly rent, plus twenty-five dollars ($25) for each additional day thereafter.”

Section 3.3

On a $2,100 rent, you'd owe $210 + $25/day after just five days late — that compounds quickly. Texas Property Code §92.019 requires late fees to be a reasonable estimate of the landlord's damages, and courts routinely strike down compound or percentage-based fees as unenforceable liquidated damages.

Recommendation — Ask to replace with a flat $50 fee after a 5-day grace period. Cite §92.019 — the landlord likely knows this clause won't survive court.

“shall be returned, if at all, within one hundred twenty (120) days after termination.”

Section 4

Texas Property Code §92.103 requires landlords to return security deposits within 30 days of move-out. The 120-day clause is unenforceable. It also says the deposit may be retained for any purpose the landlord deems necessary — without an itemized accounting requirement, which §92.104 mandates.

Recommendation — Strike the 120-day language and write in '30 days, with itemized statement of any deductions per Tex. Prop. Code §92.103/§92.104.' The landlord cannot lawfully refuse this.

“Tenant shall deposit with Landlord the sum of Four Thousand Two Hundred Dollars ($4,200.00).”

Section 4

Texas has no statutory cap on security deposits, but two months' rent is on the high end and often signals a landlord who has had collection issues. It's a real cost-of-tenancy item: $4,200 of your money sits with the landlord for a year.

Recommendation — Try to negotiate down to one month's rent. If they insist on two months, ask for the deposit to be held in a separate interest-bearing account.

Throughout

Texas has no statutory entry-notice requirement — most leases include one (commonly 24 hours). Without this clause, the landlord could legally enter at any time. This is one of the most common things to add.

Recommendation — Add a clause: 'Landlord shall give Tenant at least 24 hours' written notice before entering the Premises, except in cases of emergency.'

“Tenant shall indemnify and hold harmless Landlord from any and all claims arising from Tenant's occupancy.”

Section 11

This makes you financially responsible for any harm that happens on the property — including injuries caused by the landlord's negligence or by structural defects. Texas courts won't enforce this for the landlord's own gross negligence, but it'll be expensive to litigate.

Recommendation — Limit indemnification to claims arising from your own negligence or willful misconduct, expressly excluding the landlord's negligence.

“Tenant waives the right to a trial by jury in any dispute arising under this Lease.”

Section 18

This is generally enforceable in Texas if knowing and voluntary, but it removes one of your strongest leverage points — juries tend to be more sympathetic to tenants than judges in disputes over deposits and habitability.

Recommendation — Strike this clause if possible. It costs the landlord nothing and gives up real leverage on your side.
